Underwriting

The process of analyzing a borrower's capability to honor repayment of a loan (evaluating his or her credit, assets, employment) along with the value of the property being purchased, to help minimize the risk involved for the party lending the purchase money

Unilateral contract

A one-sided contract in which only one party is legally under obligation by the terms of the contract; one party promises an action to the second party, who is not legally required to respond, but if the second part does comply, then the first party is obligated to honor the promise made

Unsecured loan

A loan that is not guaranteed by collateral

Usury

The act of charging more than the maximum rate of interest permitted by law

First Time Buyers >Inspection Contingencies

Many of today's purchase offers include a contingency clause that allows the buyers to hire a home inspector or professional expert to inspect the property. If there is a significant defect in the property, the buyer can cancel the contract without losing the earnest money deposit. Contingencies are excellent procedures that protects both the buyer and the seller.

The time period for inspection contingencies is negotiable. In most parts of the country, the buyers have about a week in which to cancel the contract if the structural inspection reveals a serious and consequential defect. The positive side to such contingencies is that the inspection usually addresses--and overcomes--the buyers' misgivings, and confirms their decision to move ahead with the purchase.

Kristin Gwaltney was born and raised in Ashland City, Tennessee. Kristin became a Clarksvillian in 1991 when she began college at Austin Peay State University. Upon graduating from Austin Peay State University with a degree in Marketing & Sales, she went into the Nashville Film Industry Producing nationwide commercials as well as working on several public relation pieces and music videos.
